MMAPI Chat — A product of Local Growth Labs LLC
By accessing or using the MMAPI Chat platform ("the Platform") operated by Local Growth Labs LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
MMAPI Chat is a Messenger marketing and automation platform that enables businesses to manage Facebook Messenger conversations, create automation flows, send marketing messages, manage contacts, and analyze campaign performance. The Platform integrates with Facebook and Meta APIs to provide these services.
To use the Platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
To use our Messenger features, you must connect at least one Facebook Page that you own or have administrative access to. By connecting your Page, you authorize us to access and use your Page data, send and receive messages on your behalf, and manage Messenger interactions as configured by you. You represent that you have the necessary rights and permissions to connect your Page and use it with our Platform.
You agree to use the Platform in compliance with all applicable laws, regulations, and Meta/Facebook Platform Policies. You agree NOT to:
When using the Marketing Messages feature, you agree to comply with all Facebook Marketing Messages policies, including obtaining proper opt-in consent from subscribers before sending promotional messages, honoring opt-out requests promptly, and providing clear identification of your business in all marketing messages.
Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for complying with all applicable data protection laws (including GDPR, CCPA, and others) with respect to the personal data you collect from your subscribers through the Platform.
The Platform, including its design, code, features, and content, is owned by Local Growth Labs LLC and protected by intellectual property laws. You retain ownership of your content (messages, images, automation flows) that you create using the Platform. By using the Platform, you grant us a limited license to process your content as necessary to provide the service.
We strive to maintain high availability of the Platform but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions caused by third-party services (including Facebook/Meta APIs), force majeure events, or scheduled maintenance.
To the maximum extent permitted by law, Local Growth Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if required by Meta/Facebook. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes via email or through the Platform. Continued use after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles.
